Clear, practical terms for using the ARC website, accessing its content and purchasing digital guides or booking services.

These Terms & Conditions explain the rules for using the ARC website. They also set out the basic terms that apply when you access ARC content, buy a digital guide or use the website to book an ARC service.

By using the website, you agree to these terms. If you do not agree, please stop using the website. Any service-specific terms shown during booking or checkout will also apply to that purchase or booking.

1. About ARC

The website is operated from the United Kingdom by Paul Lindsell Ltd, trading as Algarve Relocation Concierge (ARC), of 33 Catisfield Road, Fareham PO15 5LT, United Kingdom. ARC provides services and information relating to the Algarve, Portugal, but the business is managed and administered from the United Kingdom. You can contact ARC at hello@arcportugal.com.

ARC provides independent, buyer-side area orientation, lifestyle-fit guidance, property scouting and observational reporting for people considering buying, renting or relocating in the Algarve.

2. What these terms cover

These terms apply to:

  • browsing and using the ARC website;
  • reading articles, area information and other free content;
  • buying or downloading ARC digital guides;
  • submitting forms, enquiries, questionnaires or property links; and
  • using the website to book or enquire about ARC services.

A specific paid service may have additional terms, a cancellation policy, a written scope or a client agreement. Where there is a conflict, the more specific terms for that service will apply.

3. Using the website

You may use the website for personal and lawful purposes. You must not:

  • use the website in a way that breaks the law or infringes another person’s rights;
  • attempt to damage, disrupt, overload, hack or gain unauthorised access to the website or its systems;
  • introduce viruses, malicious code or automated tools that place an unreasonable load on the website;
  • scrape, copy, republish or commercially exploit ARC content without written permission;
  • pretend to be another person, provide deliberately false information or misuse contact forms; or
  • use ARC content or branding in a way that suggests an endorsement, partnership or agency relationship that does not exist.

ARC may restrict or block access where it reasonably believes the website is being misused.

4. Information on the website

ARC aims to make its content useful, balanced and accurate. However, local conditions, property markets, prices, regulations, schools, transport, businesses and other information can change. Website content may also be based on general area observations rather than the circumstances of a particular buyer or property.

You should therefore use website content as a starting point, not as the sole basis for a property, financial, legal or relocation decision. Please verify important facts before acting on them.

5. ARC’s role and professional boundaries

ARC provides buyer-side context and practical observations. Unless ARC expressly agrees otherwise in a separate written agreement, ARC does not act as:

  • an estate agent or property mediator;
  • a lawyer, tax adviser, accountant or immigration adviser;
  • a mortgage or investment adviser;
  • a surveyor, architect, engineer or property valuer;
  • a formal negotiator or transaction representative; or
  • a substitute for legal due diligence, a technical survey or regulated professional advice.

Before making a purchase, investment, legal, tax, mortgage, planning, rental-licensing or construction decision, you should instruct the appropriate qualified professionals.

6. Purchases, bookings and contracts

Prices, service descriptions, availability and any important conditions will be shown on the relevant sales, booking or checkout page. Please review them before paying.

A purchase or booking is normally accepted when payment is successfully completed and ARC or its platform provider sends a confirmation. ARC may decline or cancel an order where there is an obvious pricing or description error, suspected fraud, lack of availability or another reasonable operational issue. If ARC cancels a paid order before supplying it, the amount paid will be refunded.

You must be at least 18 years old, or have authority from the person or organisation you represent, to make a purchase or booking.

7. Digital guides and downloads

ARC digital guides are supplied for the buyer’s own personal use. Unless the product page says otherwise, one purchase gives the buyer a personal, non-transferable right to access and use the guide. It does not transfer copyright or permit resale, public sharing, commercial distribution or uploading to another platform.

Digital guides are general buyer-side information products. They are not personalised advice and may not reflect changes that happen after the guide’s stated version or publication date.

Where consumer law gives a cancellation period for online purchases, the checkout process may ask you to expressly request immediate access to digital content and acknowledge that your cancellation right may end once delivery begins. Your statutory rights are not reduced by these terms.

If a download is defective or cannot be accessed, contact ARC with your order details so the issue can be investigated and, where appropriate, the file can be re-supplied or another suitable remedy provided.

8. Service bookings, rescheduling and cancellations

Booking pages may include a separate cancellation or rescheduling policy. Please read that policy before confirming the booking.

Where you ask ARC to begin providing a service during any legal cancellation period, ARC may request your express agreement. If you later cancel where the law allows, you may be required to pay for the part of the service already provided. Nothing in an ARC booking policy removes rights that cannot legally be excluded.

ARC may need to reschedule a service because of illness, safety, property access, weather, travel disruption or another reasonable cause. ARC will try to offer a suitable alternative or, where that is not possible, an appropriate refund for the affected service.

9. Payments and third-party platforms

ARC may use trusted third-party providers to process payments, deliver digital products, manage bookings, host forms or send emails. Those providers may have their own terms and privacy information.

ARC does not normally receive or store full payment-card details. Payment providers are responsible for processing those details through their own secure systems. ARC is not responsible for a third-party platform’s separate service, outage or terms, although ARC will reasonably assist with an ARC order or booking problem.

10. Intellectual property

The ARC name, branding, website design, guides, text, graphics, maps, scorecards, photographs, videos and other original content are owned by ARC or used under permission or licence.

You may view the website and print or save reasonable extracts for your own personal, non-commercial use. You may not copy an entire guide or substantial part of the website, remove ownership notices, adapt the material for resale, train a commercial content product on it, or publish it elsewhere without ARC’s written permission.

11. Information and material you send to ARC

When you submit an enquiry, questionnaire, property link, document, photograph, video or other material, you confirm that you are entitled to share it and that doing so does not infringe another person’s rights.

ARC may use the material to respond to your enquiry, assess a requested service and provide the agreed work. ARC will handle personal information in line with its Privacy Policy.

Please do not send highly sensitive originals or information that ARC has not asked for. You remain responsible for keeping copies of anything important that you submit.

12. Third-party links and recommendations

The website may link to estate agents, lawyers, builders, schools, restaurants, public services, booking platforms or other third parties. Links and introductions are provided for convenience and do not automatically mean ARC controls, guarantees or endorses everything offered by the third party.

You should carry out your own checks and enter into any contract with a third party directly. Unless ARC clearly states otherwise, ARC is not a party to that contract and is not responsible for the third party’s advice, work, prices, availability or conduct.

Where ARC may receive a referral fee or other benefit from an introduction, ARC will disclose this where required or appropriate.

13. Website availability and security

ARC may update, suspend or remove parts of the website without notice. ARC does not promise that the website will always be available, error-free or compatible with every device or browser.

ARC takes reasonable steps to keep the website secure, but no online service can be guaranteed to be completely free from malicious activity. You are responsible for using appropriate device security, keeping passwords private and maintaining your own backups.

14. Responsibility and liability

ARC is responsible for loss or damage that is a reasonably foreseeable result of ARC breaching these terms or failing to use reasonable care and skill. ARC is not responsible for loss caused by information you provide that is incomplete or inaccurate, by decisions made without appropriate professional checks, or by events outside ARC’s reasonable control.

To the fullest extent permitted by law, ARC is not responsible for indirect or purely economic losses arising only from general website use, such as loss of opportunity, expected profit, anticipated savings or business interruption.

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or mandatory consumer rights.

15. Privacy and cookies

ARC’s Privacy Policy explains how personal information is collected and used. The Cookie Policy or cookie settings explain how cookies and similar technologies are used.

These documents form part of the website information and should be read alongside these terms.

16. Complaints and consumer support

If you have a problem, please contact ARC first at hello@arcportugal.com. ARC will try to understand the issue and resolve it fairly.

If you are a consumer in England or Wales, you can obtain independent guidance about your consumer rights from the Citizens Advice consumer service. Consumers in Scotland or Northern Ireland can use the equivalent consumer advice service for their nation.

Where appropriate, ARC and the customer may agree to use an approved alternative dispute resolution provider. If a particular provider is required by law or agreed for a specific dispute, ARC will provide the relevant details. This does not affect either party’s right to use the courts.

17. Governing law

These terms, and any dispute or claim arising from them or from use of the website, are governed by the laws of England and Wales. The courts of England and Wales will have non-exclusive jurisdiction. If you are a consumer living outside England and Wales, you may also benefit from mandatory rights under the laws of your country of residence and may be able to bring a claim in your local courts.

ARC prefers to resolve concerns directly and constructively before court proceedings are considered.

18. Changes to these terms

ARC may update these terms to reflect changes to the website, services, business practices or law. The current version will be published on the website with the “last updated” date.

Changes will apply from the date they are published and will not normally change the agreed terms of an existing paid order or booking unless the change is required by law or is accepted by both parties.

19. General points

If one part of these terms cannot be enforced, the remaining parts will continue to apply. A delay in enforcing a right does not mean that right has been given up.

You may not transfer your rights under a paid order or booking without ARC’s written agreement. ARC may transfer the operation of the website or its rights and obligations as part of a genuine business reorganisation, provided this does not reduce your mandatory rights.
